Compliance & Nondiscrimination

The City of San Marcos is committed to providing equitable access to services, programs and activities. The city complies with Federal civil right laws and is committed to providing its programs and services without discrimination. 

  • Title VI of the Civil Rights Act of 1964, which prohibits discrimination based on race, color, or national origin (including language). 
  • Section 504 of the Rehabilitation Act of 1973, which prohibits discrimination based on disability. 
  • Title IX of the Education Amendments Act of 1972, which prohibits discrimination based on sex in education programs or activities. 
  • Age Discrimination Act of 1975, which prohibits discrimination based on age. 
  • U.S. Department of Homeland Security regulation 6 C.F.R. Part 19, which prohibits discrimination based on religion in social service programs. 

It is against the law for the City of San Marcos to retaliate against anyone who takes action to oppose discrimination, files a grievance, or participates in the investigation of a grievance in accordance with the above authorities. 

Title VI of the Civil Rights Acts of 1964 Compliance

As a recipient of federal funds, City of San Marcos has a Title VI grievance procedure, which outlines a process for reporting local Title VI complaints. 

Title VI of the Civil Rights Act of 1964 and related statutes (Title VI) prohibits discrimination on the basis of race, color, or national origin (including Limited English Proficiency) in any program or activity that receives federal funds or other federal financial assistance.

Programs that receive federal funds cannot distinguish among individuals on the basis of race, color or national origin, either directly or indirectly, in the types, quantity, quality or timeliness of program services, aids or benefits that they provide or the manner in which they provide them. This prohibition applies to intentional discrimination as well as to procedures, criteria, or methods of administration that appear neutral but have a discriminatory effect on individuals because of their race, color, or national origin (including Limited English Proficiency).

Americans with Disabilities Act Compliance

The City of San Marcos complies with the Americans with Disabilities Act of 1990, Public Law 101-336, which prohibits discrimination on the basis of disability. The city has an established grievance procedure to meet the requirements of the Americans with Disabilities Act of 1990 ("ADA")/Section 504 of the Rehabilitation Act 1973 (Section 504).

In accordance with the requirements of Title II of the Americans with Disabilities Act of 1990 and Section 504 of the Rehabilitation Act of 1973, the City of San Marcos will not discriminate against qualified individuals with disabilities on the basis of disability in its services, programs or activities.

Employment
The city does not discriminate on the basis of disability in its hiring or employment practices and complies with all of the regulations promulgated by the U.S. Equal Employment Opportunity Commission under Title I of the Americans with Disabilities Act (ADA).

Effective communication
The City of San Marcos will generally, upon request, provide appropriate aids and services leading to effective communication for qualified persons with disabilities so they can participate equally in City of San Marcos’ programs, services, and activities, including qualified sign language interpreters, documents in Braille, and other ways of making information and communications accessible to people who have speech, hearing, or vision impairments.  

Modifications to policies and procedures
The city will make all reasonable modifications to policies and programs to ensure that people with disabilities have an equal opportunity to enjoy all city programs, services and activities.  For example, individuals with service animals are welcomed in City of San Marcos offices, even where pets are generally prohibited.

The ADA does not require the city to take any action that would fundamentally alter the nature of its programs or services or impose an undue financial or administrative burden. 

The City will not place a surcharge on a particular individual with a disability or any group of individuals with disabilities to cover the cost of providing auxiliary aids/services or reasonable modifications of policy.

The City of San Marcos will not place a surcharge on a particular individual with a disability or any group of individuals with disabilities to cover the cost of providing auxiliary aids/services or reasonable modifications of policy, such as retrieving items from locations that are open to the public but are not accessible to persons who use wheelchairs.

Language Access Plan

The City of San Marcos uses a Language Access Plan(PDF, 433KB)  which provides a cohesive approach to ensure language access throughout the city for limited English proficient (LEP) individuals. 

The city is working to implement the various recommendations included in the Language Access Plan and is committed to providing language access services to LEP residents and the general public.

Report a Concern

The Human Resources-Risk Division works to protect the city’s human resources and other city-wide assets, in respect to risk management. The division seeks to use preventative measures for protecting city employees and other resources whenever possible, including providing a safe work environment, providing regular safety trainings for employees and engaging an active safety committee to provide a systematic review of incidents while evaluating and updating safety procedures.

The Human Resources-Risk Division manages all claims against the city, including Worker’s Compensation claims. Claims management includes assisting claimants during the claims process, investigating each claim, evaluating potential liability and making recommendations regarding claim resolutions.
