Before you lease or buy

Step 1.Verify existing permits

Step 2.Check the zoning

Check the property's zoning rules early, since some uses need extra permits or aren’t allowed in certain areas. This helps you avoid delays when applying for a business license.

Do you need a permit?

Step 1.Is the building changing?

Most construction or improvement work requires a permit. Review our Exempt Work list to see if your project qualifies. Common examples of work needing permits include:

Racking/storage: New storage systems—especially taller installations—may require permits, as they can affect fire sprinklers and safety standards. Requirements also depend on what materials you’re storing.

Restroom updates: Modifying restrooms can affect plumbing and may require updates to meet current building codes.

Addition of walls: Even non-structural walls require permits.

Step 2.Are you using the space differently?

Some business activities can trigger a building code “change of occupancy,” which is different from zoning use. This often affects businesses in commercial or industrial spaces, such as:

  • Dance studios
  • Gyms
  • Churches
  • Schools
  • Breweries

Depending on your new use, you may need ADA-compliant bathrooms and parking, improved sidewalk or ramp access, HVAC upgrades or updated fire-protection systems.

  • Tenant improvements help customize a space, but it’s important to understand the permitting process, timelines, and requirements before work begins.
  • Whether the owner or tenant is completing the improvements, check early for any additional approvals needed from utility providers such as SDG&E or your water and sewer agencies, which may require separate permits.

Build your improvements

Step 1.Hire a professional

You may need to hire a design consultant (architect, engineer, etc.) to prepare site plans. A skilled designer or licensed contractor can expedite the permitting process. When vetting a licensed professional, consider:

  • Their experience with similar projects.
  • References and reviews (prior work in the city does not guarantee quality).
  • Verify status of Architect and Engineer Licensing and standing on the State of California’s website.
  • Status of Contractor Licensing and standing on the State of California’s website
  • Whether they understand your project goals. Have a clear understanding of what you want/need and be able to clearly articulate it.
  • Understand your budget and be able to provide it to your designer.

Step 2.Submit your plans

After you apply for a building permit, the city will review your plans and either approve the permit or return comments to you.

Step 3.Schedule inspections

Once you get your permit, your contractor will need to schedule inspections of the construction at key points in the process. Be sure your contractor allows time in the schedule for these important check ins. 

Step 4.Get your business license

All businesses operating in the City of San Marcos must apply for a business license.
